A Hagerstown man was charged with first-degree assault and other counts after he allegedly pulled a handgun while he was repossessing a vehicle Tuesday.
Frank M. Burrell Jr., 27, of Wood Street also was charged with second-degree assault; handgun on person; illegal possession of a regulated firearm; illegal possession of ammunition; firearm use in a crime of violence; and reckless endangerment, according to court documents.
A conviction on a charge of first-degree assault carries a maximum sentence of 25 years in prison.
Police were called at 4:13 p.m. to 326 N. Mulberry St. in Hagerstown for a vehicle theft in progress. The caller told officers that a man taking the vehicle pulled a black handgun and threatened her, according to the statement of probable cause.
The victim, Lisa Teal, claimed that a man named "Frank" came to the house to look for a car that her granddaughter's boyfriend, Juan Munoz, had just bought.
When Teal ordered "Frank" to get off her property, he allegedly pulled out a black handgun from his waistband and said: "If I go to jail, you will get this," the charging documents said.
Police said "Frank" left the area in a silver car, and his associate drove away in the car they came to repossess.
Munoz told police that he bought a black Volkswagen from a man he knew only as "Frank" a few weeks before for $2,000.
Munoz gave "Frank" $1,000 in cash and received a dealer's tag in exchange. Munoz was to get the title when he paid the remaining $1,000, the documents said.
Munoz said he didn't know Frank's last name and gave police his telephone number. Investigators tracked the number to Frank Burrell.
Police then got a picture of Burrell from a previous arrest and used it in a photo array, the documents said.
Officers said Teal viewed the photo array shortly after the incident and identified Burrell, with 80-percent certainty, as the man who pulled the gun.
Police found the Volkswagen with two flat tires in the area of the 100 block of Broadway. The car was towed, and officers deemed the car issue a civil matter, the documents said.
Burrell was taken into custody later that night when he tried to pick up the car from the towing company, the documents said.
An investigation revealed that Burrell was disqualified from possessing ammunition or a handgun for five years because of his habitual use of narcotics.
Burrell was released from the Washington County Detention Center on Wednesday after posting a $75,000 bond.
His preliminary hearing is scheduled for Dec. 8.
