    Half-tank of gas spurs $5M suit

    Woman says Ally was wrong to keep fuel in her repossessed car



    Victoria Jean Church-Dellinger filed a $5 million class-action suit in federal court against Ally Financial Inc. for keeping the half a tank's worth of gas in her 2008 Pontiac G6 when it was repossessed.
    "It's the same as if you left your jacket in there and they didn't return it to you," Brian Parker, her Bingham Farms attorney, said in an interview. "You can't take someone's coat or fuzzy dice, and you have to return the gas."
    Church-Dellinger, 43, wants more than $5 million, which represents three times the fair market value of all gasoline taken from Michigan residents by the Detroit-based automotive financial services company over the last six years, according to the suit. She also wants the Detroit-based auto lender, which is majority-owned by the U.S. government, to return all gasoline seized during that time or pay fair market value.
    And she wants Ally in the future to give owners whose vehicles are repossessed credit for gasoline left in the tank.

      In my opinion it is as simple as this. We are not required to work for free. It would not only require labor, but also equipment for the hazardous nature of gas as well as other things that could be extremely dangerous. Next she could sue for the tread on the rear tires that was worn towing the unit. I would be more than surprised if the court allows this to go on.

        If she knew the car was delinquent , why did she put gasoline in it?

        It would be up to the auction to pay her for her fuel if she could prove it had a siginificant amount in it.

        Who would determine the amount of fuel or grade of fuel?

        Fuel in the fuel tank is like unto oil in the crank case or transmission fluid in the transmission.

        What about the windshield washer detergent? Does she get that back?

          what about the fact she might have destroyed the interior or dogged it and her and all other debitors say I want my 50 back for the gas I just put in it. I say I hope ally wins and counter sues for time wasted etc.

            She had the money to pay an attorney to file the lawsuit but not to pay her car note.

              I say she owes the lender half tank gas.... I'm sure when she bought the car it came with a full tank.....

                well thats were you and some other companys or recovery agents are WRONG.... Dont need money to hire a lawyer.....the called PRO-BONO...If the layers thing he can make money out of the case...he will take it for free, and get the 50% of the winnings...In this case if he wins he will make 2.5 mil.....EASY MONEY

                  This is not an issue on my repo's as there is always less than a gallon in them. It amazes me how many cars can't make it 10 miles to my lot (if I have or get keys). People must put it $2 at a time.

                      I know....and i thing all those law suites are so fn stupit....Look at MC Donalds...1million dollars awarded for that lady because her coffeey was HOT.....Are you kidding me ????? The lawyers make all the money

                          Reminds me of the time I was being sued because I wrinkled a debtors suite jacket because it was put into a bag... Yes for a dry cleaning bill of 3 bucks and 5k for emotional distress...

                          I hope this gets tied up in court for 20 years and the lawyer gets jack **** and makes himself look bad...

                            Some of those are legit. I thought the McDonalds thing was bogus too till I saw a video. But, there is a need for tort reform, but how do you keep it fair to where the little guy doesn't just get steamrolled? Think you watch it on Netflix. Link below.
