Police: Man shot gun to halt repo man
PORTAGE TOWNSHIP | A man who didn't want his Hummer H2 to be repossessed pointed a gun at the tow truck driver who was trying to take the sport-utility vehicle and shot a tow truck tire, Porter County police said.
The SUV owner, Eduardo Loza, 40, of 630 Merganser Drive, Portage Township, was arrested Sunday night on charges of criminal recklessness and intimidation.
Police responded to Loza's home after the tow truck driver, Ralph Borman, of Griffith, reported the confrontation at 8:15 p.m. Sunday.
Borman told police he went to Loza's home and got the Hummer ready to move. He told police he then knocked on Loza's front door and asked for the vehicle's keys.
Borman said Loza came out and expressed "discontent" with the repossession, then went back in his home and retrieved a gun, police said. Borman told police Loza pointed the gun at him and told him there was no way he was going to take the Hummer. Loza demanded Borman release the Hummer and shot the right rear tire of the tow truck, police said.
Borman released the Hummer and left the scene to call police.
According to police:
Loza admitted shooting the tire but denied pointing the gun at Borman. Loza said he wasn't happy that someone was "stealing" his Hummer, but he admitted he knew the Hummer was being repossessed because he is behind on payments. He was planning to take care of the issue Monday.
Loza acknowledged that the tow truck driver was not a threat to him or his family, but he didn't appear to understand the severity of what he did.
Loza, who faces up to four years in prison if convicted of the charges, was taken to Porter County Jail. His two handguns were confiscated.
