  • Leaving a voice message

    Leaving a voice message when trying to locate or contacting a debtor may not be as innocent or as simple as one might think it to be.

    Many clients will require you to "call the number" on the order all the while knowing those numbers are old numbers or numbers where the person you are looking for is not located at such as an old place of employment or maybe a distant relative.

    While doing some research on improper 3rd party disclosure I found an article that I thought was worth sharing.

    The article is titled "FTC Settles with Two Debt Collectors over Alleged FDCPA and FTC Act Violations".

    The part that caught my attention was "Improperly communicating with third parties, including disclosing consumers’ alleged debts to third parties through communications that included voicemail messages left on general business lines or shared home lines and asking third parties to pass messages to the consumer on the company’s behalf".

    BTW, the civil penalties assessed in this case were $1.5 million and $1.2 million.

      The same could hold true for anyone leaving a calling card or business card at the address as well, because you can't verify who's going to get hold of it.
